HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU WP(C) No. 2519/2025 Dhanuka Agritech Ltd. Th. Sandeep Jagotra .....Appellant(s)/Petitioner(s) Through :- Mr. Amrinder Singh, Advocate Mr. J.A. Hamal, Advocate v/s Union of India and ors. .....Respondent(s) Through :- Mr. Dheeraj Nanda, CGSC CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDER (ORAL) 11.09.2025 Sanjeev Kumar J 1. The short grievance projected by the petitioner in this petition is that with a view to claiming refund on account of budgetary support, the petitioner filed his claims for different quarters and claimed a sum of Rs. 30,55,28,411/- , however the respondents only released a sum of Rs. 22,49,48,591/-. It is thus submitted that a sum of Rs. 8,05,79,820/- is still outstanding. 2. Learned counsel appearing for the petitioner submits that since the respondents have not passed any formal order indicating reasons for not disbursing the entire amount claimed by the petitioner, as such, he is at loss to understand as to on what basis his claim for a sum of more than 8 crore has not been accepted. 3. Having regard to submission made by the learned counsel for the petitioner and the limited relief prayed for, this petition is disposed of by directing the respondents to pass a formal order indicating Sr. No. 53 2 WP(C) No. 2519/2025 reasons as to why the claim of Rs. 8,05,79,820/- has not been accepted. The respondents shall be free to requisition any additional information as may be required from the petitioner. While considering the issue, the respondents shall take into consideration the office memorandum issued by the Ministry of Commerce and Industry/Department For Promotion Industry and Internal Trade, Government of India on 10.07.2025. Let the entire exercise be completed within a period of four weeks from today and an appropriate order be passed within one week after completion of the exercise. 4. Disposed of.
