The petitioner renews his prayer for bail which was rejected twice earlier, lastly on May 03, 2024. He says that he is in custody for more than two years two months. Even charge has not been framed. The last date was yesterday (21.01.2025). Nothing happened yesterday. 2. We are told that there are 70 charge sheet named witnesses. Trial is yet to begin. Nobody knows when the trial will conclude. An accused cannot be kept in incarceration for an indefinitely long period of time without there being any progress at all in the trial. 3. Without touching the merits of the case and solely on the touchstone of Article 21 of the Constitution of India, we feel constrained to enlarge the petitioner on bail. 4. Accordingly, we direct that the petitioner, namely, Ranbir Singh, shall be released on bail upon furnishing a bond of Rs. 2 10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Chief Judicial Magistrate, City Sessions Court, Calcutta subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that the petitioner while on bail shall not leave the jurisdiction of Boranagar Police Station except for the purpose of attending court proceedings and shall meet the Officer-in-Charge, Anti Dacoity & Robbery Squad, Detective Department, Lalbazar twice in a week until further orders. 5. In the event the petitioner fails to adhere to any of the conditions stipulated above without justifiable cause, the trial court shall be at liberty to cancel the petitioner’s bail in accordance with law without further reference to this court. 6. The application for bail is, accordingly, allowed. 7. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
