2. Learned counsel for the petitioner submits that despite the conclusion of the departmental enquiry and exoneration of the petitioner, the retiral dues have not yet been released. It is contended that the petitioner was made to suffer undue hardship owing to the prolonged pendency of the departmental proceedings, which commenced in the year 2014 and culminated only on 22.10.2025. Accordingly, it is prayed that appropriate directions be issued to the respondent–authorities to release all retiral benefits along with interest. 3. Learned counsel for the State submits that a return/reply has been filed in the matter.
Referring to paragraph 3 of the said return, it has been stated that the petitioner has already been exonerated and that the respondent–authorities are taking necessary steps to release the entire retiral dues of the petitioner at the earliest. A copy of the order dated 22.10.2025 has been annexed along with the return in support of this submission. 4. In view of the statements made in the return filed by the State and the submissions made by the State at bar is brought on record, it appears that the respondent–authorities are ready and willing to disburse the entire retiral dues of the petitioner within a period of 30 days from today. 5. Since the departmental enquiry remained pending from the year 2014 till the date of exoneration, i.e., 22.10.2025, it would be just and proper to direct the respondent/State to pay interest at the rate of 6% per annum on the delayed payment of retiral dues, to
4 be calculated from the date of disbursement of amount. 6. Accordingly, the present petition stands disposed of with the aforesaid observations and directions. Certified Copy as per Rules. Sd/- Sd/- (Amitendra Kishore Prasad) Judge U. K. Raju
