Order: The Criminal Petition, u/Sec.482 of B.N.S.S is filed on behalf of the petitioner/A2 to grant anticipatory bail in connection with Crime No.45/2025 of Prohibition & Excise Station, Narasaraopet, Palnadu District. A case has been registered against the petitioner/A2 herein and others for the offences punishable under Sections 7(B) r/w 8(e) of A.P.Prohibition (Amended) Act, 2020.

brief facts of the case are that this is a case of manufacturing of ID liquor that took place on 08.04.2025 at YSR Statue in Chejarla Village, Narakarikallu Mandal where the police found one female person having possession of one white color plastic bottle in her right hand, on seeing the police she tried to escape from there and the police catch her and police found plastic bottle and opened the bottle identified that pungent smell (Naatu Saarayi Vasana) and the plastic bottle 2 liters capacity and containing full of ID liquor. Then the police seized ID liquor and registered the crime.

Learned counsel for the petitioner submits that, based on the confession of co-accused, the crime was registered against petitioner/A2. Except for the confession of co-accused, no other independent material has been collected to show the involvement of A2 in the commission of the offence. The learned counsel for the petitioner further submits that the petitioner has a permanent abode at Chejarla Village, Palnadu District, and there is no possibility of her fleeing away from the Jurisdiction of the Court. Learned Assistant Public Prosecutor, while opposing the prayer of the petitioner, submits that the investigation is not complete. When ascertained the learned Assistant Public Prosecutor confirmed that the petitioner has no criminal antecedents.

In view of the facts and circumstances of the case, since the petitioner herein is arrayed as accused No.2 basing on the confessional statement of co-accused and the most of the witnesses are shown to be official witnesses, this Court is inclined to grant anticipatory bail to petitioner/A2, on the following conditions: The petitioner/A2 is
directed to surrender before the Station House Officer concerned within two (2) weeks from today and on such surrender, the petitioner/A2 shall be released on bail on her executing a personal bond for a sum of Rs. 10,000/- (Rupees ten thousand only) with one surety for a like sum to the satisfaction of jbe arresting police officials. After
3 release, the petitioner/A2 shall shall appear before the investigating officer as and when her presence is required. The petitioner/A2 threat, inducement cooperate for investigation and shall not cause or promise to the prosecution witnesses. any
7. Accordingly, the Criminal Petition is allowed.
