THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 8170 of 2020 ORDER: Heard the learned counsel for the petitioner and the learned Government Pleader for Panchayat Raj appearing for respondents. The case of the petitioner is that the action of respondent Nos. 2 to 4 in conducting the auction on 30.03.2020 (during lockdown) for the operational right to collect toll over Madhavaipalem Ferry, Narsapur, West Godavari District, for the period from 01.04.2020 to 31.03.2021, pursuant to the auction notice dated 19.03.2020, in spite of the COVID-19 lockdown, without giving proper publicity and opportunity to bid, and without assigning any reasons for not acting upon the initial notification dated 10.02.2020 and without cancelling the said notification, and further declaring the 5th respondent herein as the highest bidder in the said auction, is contrary to law. In view of the claim of the petitioner, as the auction period has already been completed, the cause in the present Writ Petition does not survive, and no further adjudication is necessary. Therefore, the Writ Petition has become infructuous. Recording the said submission, Writ Petition is dismissed as infructuous. There shall be no order as to costs.
