[2025:RJ-JP:46758] (2 of 3) [CW-17049/2012] 3. It is submitted that the petitioners are also entitled equal pay scale as like the persons who are working on the same post in Government Press. 4. Learned counsel appearing for the respondents submits that the petitioners have been duly sanctioned and allowed selection scale as per the Circular dated 25.01.1992. 5. Learned counsel further submits that since there is no promotional post for promotion from post of Binder on which the petitioners are working, the petitioners are entitled for pay scale as selection pay scale in view of the Clause-5 of the Government order dated 25.01.1992. 6. Considered the submissions made by counsel for the parties. 7. As per the facts on record, the petitioners were appointed as Binder vide appointment order dated 31.07.1987 in the Police Department and their services are governed by the Rajasthan Police Subordinate Service Rules, 1989. 8. As per the facts on record, there are no promotional post for the persons who are working on the post of Binder in the Police Department. The Government order dated 25.01.1992 speaks that in case there is no post for first, second or third promotion, as the case may be, in the same service/ cadre or the employee does not possess academic qualifications prescribed for promotion and in respect of the isolated posts, the Selection Grades shall made be made as specified in Clause-5. 9. [2025:RJ-JP:46758] (3 of 3) [CW-17049/2012] 10. Since the petitioners have already been accorded pay scale/selection scale as per the Government order dated 25.01.1992, the claim of the petitioners for pay scale equivalent to the persons working on the post of Binder in other department is not tenable because the pay scales are to be granted to an employee of the department as per the Rules only which have been granted to the present petitioners in accordance with the provisions of Government order dated 25.01.1992. 11. In view of the above, the Court finds no merit in the petition hence, the same is hereby dismissed. 12. Pending application, if any, also stands disposed of. (GANESH RAM MEENA),J Ashish Kumar /42
