This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 18529 of 2024 to its original file.
Learned counsel for the petitioner submits that A.B.A. No. 18529 of 2024 was dismissed for non-compliance of the peremptory
order of removing the defects. It is next submitted that as the pairvikar of the petitioner went outside hence, he could not swear the affidavit and the same resulted in delay in removing the defects. It is further submitted that non-compliance of peremptory order was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said A.B.A. No. 18529 of 2024 and unless A.B.A. No. 18529 of 2024 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that A.B.A. No. 18529 of 2024 be restored to its original file.
Considering the facts of the case and the aforesaid submission of the learned counsel for the petitioner, A.B.A. No. 18529 of 2024 is restored to its original file to the stage at which, it was before its dismissal.
List A.B.A. No. 18529 of 2024 under the appropriate heading before the appropriate bench after a week.
