1. In the covering memo, the certified copy of the bail rejection order 13.11.2025 has bee filed whereby crime number has been corrected. 2. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.353/2024 as per challan (wrongly mentioned as 353/2023 in Annexure A/1) registered at Police Station – Urla, Raipur, District - Raipur (C.G.) for the offence punishable under Sections 109, 118(1) and 296 of Bharatiya Nyaya Sanhita, 2023. 3. 2 the police station, alleging that a minor dispute occurred between both parties due to prior enmity. Subsequently, the accused assaulted the injured party. Based on this complaint, the police registered an offense under Sections 109, 118(1), and 296 of the B.N.S. Act against the applicant. 4. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submitted that at the time of incident, there was simple dispute arose between parties, but the applicant has neither assaulted upon injured person, nor committed any aforesaid offence as alleged by the prosecution against him. He also submit that the applicant has no previous criminal antecedents, the charge-sheet has been filed in this case and the applicant is in jail since 01.12.2024 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail. 5. On the other hand, the learned State counsel opposed the bail application, submitting that the charge sheet has been filed.
She further stated that the applicant is alleged to have assaulted the injured with a knife, causing an oblique stab wound to the left lumbar region of the abdomen, which were found to be grievous in nature and dangerous to life. Therefore, the applicant is not entitled to be released on bail. 6. I have heard learned counsel for the parties and perused the documents available on record. 7. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that the applicant is alleged to have assaulted the injured with a knife, causing an oblique stab wound to the left lumbar region of the abdomen, which were found to be grievous in nature and dangerous to life, this Court is of the
3 opinion that it is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, the bail application of the applicant - Raghuvir Sahu @ Bhancha involved in Crime No.353/2024 as per challan (wrongly mentioned as 353/2023 in Annexure A/1) registered at Police Station – Urla, Raipur, District - Raipur (C.G.) for the offence punishable under Sections 109, 118(1) and 296 of Bharatiya Nyaya Sanhita, 2023, is rejected at this stage. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10.
