HARI HARANADHA SARMA CRIMINAL PETITION NO: 5807 OF 2025 ORDER: This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioner who is arrayed as accused in Crime No.99 of 2025 of Rayadurgam Police Station, Anantapur District, which registered with the allegations of committing offences punishable under Sections 75, 77 of the Bharatiya Nyaya Sanhita, 2023 and Section 7 and 8 of Protection of Children from Sexual Offences Act (for short POCSO Act) was 2. While denying the allegations made against him, the petitioner/accused prays for grant of pre-arrest bail, contending that the complaint is motivated by matrimonial disputes between him and the informant, who is his wife, and that he has been falsely implicated in the present case. 3. Heard both sides. 4. Point for determination: Whether the petitioner/Accused is entitled for grant of pre-arrest bail in terms of Section 482 of BNSS? In respect of Crime No.99 of 2025 of Rayadurgam Police Station, Anantapur District If so, on what terms? Point: Case of Prosecution:- This is a case of outraging the modesty and sexual assault over minor 5. girls by the father against his daughters. The informant is the mother of the two minor girls. The accused is working at his father’s cloth shop and the informant is working as a private teacher. The daughters of informant are studying degree and intermediate. The accused has a habit of harassing informant without providing anything for maintenance of family etc. He did not change his attitude. He has developed an evil eye over the daughters of informant and used to watch when they are changing dresses and taking bath and by sleeping between them and used to misbehave by touching indecently and also by exhibiting his male organs etc., hence, the complaint. The Learned Assistant Public Prosecutor strongly opposed the bail application, contending that the offence is heinous and the case is still at the investigation stage. Recording the statements of the witnesses under Section 183 of BNSS is yet to be completed. At this stage, granting pre-arrest bail will adversely affect the investigation process. Upon considering the facts and circumstances of the case, the nature and depth of the allegations, heinous nature of offence, the prayer for grant of pre-arrest bail is found to be not convincing.
