Neutral Citation No. - 2025:AHC:62556 Court No. - 4 Case :- WRIT - A No. - 5318 of 2025 Petitioner :- Bhaibhav Dev Pandey Respondent :- Union Of India And Another Counsel for Petitioner :- Ashutosh Gupta Counsel for Respondent :- A.S.G.I. Hon'ble Ajit Kumar,J. Heard Sri Ashutosh Gupta, learned counsel for the petitioner and Sri Prem Narayan Rai, learned counsel for the respondents. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for a relief in the nature of mandamus commanding respondent No.- 2 to produce the answer sheet along with the marks obtained by the petitioner and cut off marks in the examination conducted in connection with advertisement No.- 03/2023/BARC dated 24th November, 2023. It transpires from the record that petitioner had earlier approached this Court vide Writ - A No.- 17784 of 2024 for a direction to provide answer book which has already been provided to him and the said petition was later on dismissed for having become infructuous. The question for summoning the answer key does not arise as the petitioner is already in possession of the answer key. The petitioner wants OMR answer which is nothing but an answer key which was provided to the petitioner. If the petitioner found himself to have not been awarded correct marks or that he opted correct option whereas the model answer key showed some other option to be correct answer, the duty of the petitioner was to apply for objections. Nothing has been mentioned in this petition as to why petitioner wants revaluation when he himself did not opt for raising objections to the model answer key. Even the model answer key and final answer key published by the department have not been brought on record. In my considered view, no relief as such in the given facts and circumstances can be granted to the petitioner. Petition thus fails and is, accordingly, dismissed.
