Judgment 30/10/2025
1. Present petition is filed with the following prayers:-
"a) By an appropriate writ, order and direction in the nature thereof the respondents may kindly be directed
[2025:RJ-JP:43586] (2 of 3) [CW-15704/2025] to give admission to the petitioner in MBBS Course in respondent No. 3 in pursuance to the NEET UG-25. b) Any other relief as this Hon'ble Court may deem fit and proper be also passed in favour of the Petitioner."
2.
Learned counsel for the petitioner has submitted that the petitioner was treated under-qualified by the respondents as the qualification(s) obtained by petitioner were not considered adequate.
3. Howsoever, counsel for the respondent no. 4 has specifically submitted that the qualification(s) obtained by the petitioner are adequate and the same is declared ‘valid’ after appropriate
consideration by the Board. This court vide its order dated 17.10.2025, had kept the rights of petitioner secured by keeping one seat reserved for the petitioner.
4.
Learned counsel for respondent No. 3 has made submission that the candidature of petitioner also came to be rejected by newly impleaded respondent No. 6 on the same lines and grounds. It is further submitted that there exist no dispute regarding the reservation of one seat and financial deposition between the parties and the same shall not have any prejudice, whatsoever, qua petitioner.
4. In light of the aforesaid facts and circumstances, this Court accordingly directs that upon the payment of appropriate fees by the petitioner to respondent no. 3, which shall be deposited as per the appropriate category under which the petitioner falls, the candidature of the petitioner be considered for admission in consonance with the merit scored. The said direction is given taking note of the fact that respondent no. 4, from day one, has
[2025:RJ-JP:43586] (3 of 3) [CW-15704/2025] no cognate reason for the non-consideration of the petitioner’s candidature.
5. Accordingly, the present petition is allowed.
6. However, it has been made specifically clear that the present
order may not be treated as a precedence as the same is decided under the light of special facts and circumstances.
