This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.107/2025 registered at Police Station Nandghat, District Bemetara (C.G.) for the offence punishable under Sections 331(4) & 305 (a) of Bhartiya Nayaya Sanhita. Case of the prosecution, in brief, is that the applicant has been arrested in the present case in connection with removal of gold jewelries and cash amount of Rs.2,15,000/- and silver ornaments etc. by breaking the complainant's residential house at night. The police filed the charge sheet before the concerned Court. 3. Learned counsel for the applicant submits that the applicant is said to have committed theft in the dwelling house of the complainant and has committed theft of gold ornaments and cash of Rs.2,15,000/-. He would submit that the charge sheet has been filed, applicant is in jail since 05/08/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and she would submit that charge sheet has been filed in this case. She would further submit that the applicant who has stolen the gold jewelries and the cash out of which he has prepared a mobile, motorcycle of the said amount and the applicant could not give a plausible explanation with respect to the recovery made, therefore he is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, considering the fact that the applicant has stolen the gold jewelries and the cash out of which he has prepared a mobile, motorcycle of the said amount and the applicant could not give a plausible explanation with respect to the recovery made, therefore this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail at this stage. 3 7. Accordingly, the bail application of applicant Rakesh Sahu @ Lallu involved in Crime No.107/2025 registered at Police Station Nandghat, District Bemetara (C.G.) for the offence punishable under Sections 331(4) & 305 (a) of Bhartiya Nayaya Sanhita, is rejected at this stage. 8.
