THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 12573/2021 ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to (i) to issue a writ or order or direction more particularly in the nature of Writ of Mandamus challenging the inaction of the Respondent Nos.4to 6in not submitting an Assessment Report about the Atrocity to the State Government in Cr.No.99/2021, dated.
02/04/2021, which is mandatory under Rule 6 of SCs and STs (Prevention of Atrocities) Rules, 1995 and also (ii)To challenge the inaction of the Respondent No.3/District Collector in not recommending the action against the Respondent No.5/Deputy Superintendent of Police as per Section 4 of SCs and STs (Prevention of Atrocities) Act, 1989, the inaction of the Respondent Authorities is illegal, arbitrary and also violation of Section 3 and 4 of SCs and STs (Prevention of Atrocities) Act, 1989 and also violation of Article 21 of the Constitution of India and consequently (iii)To direct the Respondent Authorities to take all the necessary steps U/S 3 and 4 of the Act and Rules, 1995 and also direct the Respondent No.3/District Collector to pay the monitory Relief Amount of Rs.1,50,000/- (Rupees One Lakh and Fifty Thousand Only) to the Petitioner and as per Rule 12 (4) of SCs and STs (Prevention of Atrocities) Act, 1989 and further (iv)To direct the Respondent Authorities to prevent the continuation of the Atrocities in the Name of Caste against the Petitioner and his family members at his Village forthwith and pass…”
2. Heard Sri Y.Balaji, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 4

The grievance of the petitioner herein is that the District Collector/respondent No.3 is not recommending any action against the Deputy Superintendent of Police as per Section 4 of SC’s & ST’s (POA) Act. 4. Learned Assistant Government Pleader for Home for the respondents would submit that the petitioner has submitted a representation before the Tahsildar seeking compensation. 5. Considering the submissions, this Writ Petition is disposed of.
However, the respondent No.3/District Collector is directed to look into the representation of the petitioner if any, pending, seeking compensation in Crime No.99 of 2021, of the year 2021 and take appropriate decision over the matter according to law as expeditiously as possible, within a period of two (2) months from the date of receipt of copy of this Order. Coming to the relief claimed against the respondent No.3 for his inaction in recommending the action against the respondent No.5 is concerned, it is left open to the petitioner to work out his remedy before the appropriate forum according to law.
