Heard the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in taking steps for dispossession of the petitioners from the land in an extent of Ac.3.00 cents in Sy.No.1513 situated in Chinnampalli Village, Badvel Municipality limits, YSR Kadapa District by way of marking layout plan for allotment of house sites under the <Navaratnalu= scheme. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 5th respondent submits that the land in Sy.No.1513 is sub-divided into Sy.Nos.1513-1, 1513-2 and 1513-3. The land in an extent of Ac.10.40 cents in Sy.No.1513-3 of Chennampalli Revenue Village is a Government land and there is no dispute in this regard and no one is in possession of the same. Hence question of dispossession or eviction of the petitioners does not arise as they are not in possession at any point of time. The subject land is situated within 2 kilometers from the peripheral of Mandal Headquarters and within the limits of Municipality and as such no assignment proposals can be recommended in favour of the petitioners for the subject land. The District Collector, Kadapa issued an endorsement to the petitioners duly rejecting their plea with respect to the assignment of the 4 HBKM,J W.P.No.21833 of 2020 subject land based on the subject letter said to have been addressed by the then Tahsildar dated 16.12.2020. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 6 are directed to deal with the subject land in an extent of Ac.3.00 cents in Sy.No.1513 situated in Chinnampalli Village, Badvel Municipality limits, YSR Kadapa District, strictly in accordance with law, if so warranted for any public purpose and if not already utilized by now for the above said purpose of welfare scheme of housing for the poor. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
