By way of filing of the instant petition, a prayer has been made for quashing the F.I.R. No.341/2021 registered with Police Station Singhana, District Jhunjhunu for the offences under Sections 147, 148, 149, 427, 308, 382 & 506 of IPC. 2. Learned counsel for the petitioners submits that the complainant-respondent side was carrying out illegal mining activities, which was protested by the petitioners qua villagers/habitants of the area. Counsel submits that when a protest was made by the villagers/petitioners against the aforesaid illegal act of the complainant-respondent, the complainant- respondent approached the police officials and the instant false F.I.R. was lodged against the petitioners on the basis of incorrect facts. Counsel submits that in fact none of the persons has sustained any injury and even then, the petitioners have been [2025:RJ-JP:43425] (5 of 5) [CRLMP-2282/2022] falsely booked for the above stated offences. Counsel submits that under these circumstances, interference of this Court is warranted. 3. Per contra, learned Public Prosecutor as well as counsel appearing on behalf of the complainant-respondent opposed the arguments raised by counsel for the petitioners and submits that the allegations made in the instant F.I.R. reveal the commission of a cognizable offence, and the same has been investigated by the investigating agency and consequently, a charge-sheet has also been submitted against the accused-petitioners and now, they are facing trial before the competent Court of law. Hence, interference of this Court is not warranted and the petition is liable to be rejected. 4. Having regard to the facts and circumstances of the case, this Court is of the view that the allegations made in the F.I.R. disclose the commission of a cognizable offence and after investigation, charge-sheet has also been submitted against the accused persons before the competent Court of law where charges have already been framed. Hence, under these circumstances, the correctness and genuineness of the allegations cannot be adjudicated by this Court under its inherent jurisdiction contained under Section 528 of BNSS, and the petitioners would be at liberty to take all available defence at the appropriate stage of trial. 5. With the aforesaid observations, the instant petition stands disposed of. Stay application and all pending application(s), if any, also stand disposed of. (ANOOP KUMAR DHAND),J Aayush Sharma /67
