THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 26712 OF 2025 ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue an order, direction or writ, more particularly one in the nature of writ of Mandamus, declaring the action of the respondent No. 2 to 4 not to interfering with Civil dispute exists between petitioners and respondents 5 and 6 in respect of the suits in O.S Nos. 84, 85 and 86 of 2021 pending before the Honble Senior Civil Judge at Proddaturu Kadapa District, as illegal arbitrary unjust and unconstitutiona l and violated of Article 300 (A) and 21 of the Constitution of India and consequently direct the 4TH respondent calling the petitioners to police station and pressurize to compromise Civil dispute, and pass.....…”
2. Heard Sri M.Venkata Ramana Reddy, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home appearing for the official respondents. 3. The grievance of the petitioner is that the respondent police have been interfering in purely civil disputes between the petitioner and the unofficial respondents. It is alleged that the petitioner is being frequently called to the police station and pressurized to settle the matter, though the dispute is civil in nature. 4. Learned Assistant Government Pleader for Home, on instructions, submits that the respondent police are not interfering in the subject matter of dispute and are not calling the petitioner to the police station. 4

In the present case, since the learned Assistant Government Pleader has categorically submitted that the police are not interfering in the civil dispute and no coercive action is being taken against the petitioner, this Court is of the view that no further orders are required in this matter. 06. Accordingly, the Writ Petition is disposed of. However, the petitioners are at liberty to work out their remedies before the competent Civil Court in respect of the property dispute. The police shall strictly adhere to follow due process of law and shall not summon or detain the petitioners at the police station or interfere in civil disputes in the absence of registration of any cognizable offence. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________
