The appellant has 2led the instant appeal under Section 374(2) of the Code of Criminal Procedure, 1973, (hence forth ‘the Cr.P.C.’) questioning the judgment of conviction and order of sentence dated 26.11.2016 passed by the learned Special Judge (NDPS) Act, Ambikapur, District- Surguja, Chhattisgarh in Special Criminal Case No. 15/2014, whereby the apellant has been convicted and sentenced as under:- Conviction Sentence Section 22(b) of Narcotic Drugs and Psychotropic Substances Act. Imprisonment for 5 years and 2ne of Rs. 25,000/- in default of 2ne 2 years additional R.I 3. A PUD has been received from learned Special Judge (NDPS) Act, Ambikapur, District- Surguja, Chhattisgarh stating that appellant herein has died on 20/09/2024, which is supported by a death certi2cate issued by the Registrar Birth and Death, District Hospital Ambikapur. 4.
