Narayana Reddy, Kothapalle, Komarole Mandal, Prakasam District - A.P. ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the Respondents in not disbursing the Salaries of the petitioners for the months of September and October 2017 as illegal, arbitrary and violation of Art. 14, 19 and 21 of Constitution of India and consequently direct the Respondents to release the salary of the petitioners for the months September and October 2017 IA NO: 1 OF 2017(WPMP 47178 OF 2017 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the Respondents to disberse the salaries of the petitioner for the months of September and October 2017 pending disposal of the above writ petition Counsel for the Petitioners: C SUNIL KUMAR REDDY 4 Counsel for the Respondents: GP FOR HIGHER EDUCATION (AP) The Court made the following order: 5 HON’BLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION No.37982 OF 2017 ORDER: The instant writ petition has been filed by the petitioners under Article 226 of Constitution of India seeking the following main prayer: <to issue a writ order or direction more particularly one in the nature of writ of mandumus declaring the inaction of the Respondents in not disbursing the Salaries of the petitioners for the months of September and October 2017 as illegal, arbitrary and violation of Art. 14, 19 and 21 of Constitution of India and consequently direct the Respondents to release the salary of the petitioners for the months September and October 2017 and to pass…..= 2. The principle grievance of the petitioners is that the respondent authorities are not releasing the salaries of the petitioners for the period of two months, i.e. from September 2017 to October 2017. 3. No representation for the petitioners. 4. The learned Government Pleader for 4th respondent filed counter affidavit on 11.08.2018, wherein inter alia contended and in para 5 of the counter affidavit, it is specifically stated that the payment of salaries to the staff working in the school are stopped. After filing of the writ petition by the petitioners, salaries of the writ 6 petitioners who are working in two schools were released from September 2017 vide proceedings No.2993-1/B3/2017, dated 19.12.2017. To substantiate the same, the said proceedings are also enclosed along with the counter affidavit. 5. Taking into consideration the submissions made by learned Assistant Government Pleader as well as the recitals made in the counter affidavit and also in view of the fact that the petitioners are already received their salaries for the required period. Hence, the writ petition is dismissed. 6. There shall be no order as to costs.
