GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following: 3 THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO:24130/2025 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of respondents 2 to 4 in taking proper steps for supply of water connection to Petitioner’s house bearing Nos.11-235 (Old), 11- 323 (old), 10-203 (Old) now 10-103 of Nagayalanka Village, Nagayalanka Mandal, Krishna District inspite of his representation dated 30.6.2025 which has been received by the respondents 2 to 4 on 30.6.2025 and 3.7.2025 respectively as illegal, arbitrary and capricious and violation of petitioners fundamental rights guaranteed under the Constitution of India and consequently direct the respondents to provide water service connection to the said house forthwith in the interest of justice and to pass such other order or orders….” 2. Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 3. Learned counsel for the petitioner submits that the petitioner herein is the resident of Nagayalanka Village and Mandal, Krishna District and he has been residing in the house bearing No.11-235 (Old), 11-323 (old), 10-203 (Old) now 10-103 of Nagayalanka Village, Nagayalanka Mandal, Krishna District from the last 20 years. For which, he has been paying all the taxes regularly. While so, the petitioner herein submitted a representation dated 4 30.06.2025 to respondent Nos. 2 to 4 requesting them to provide water service connection to the subject house. Even after receipt of the said representation, till date, the respondents neither considered the same nor acted upon. Hence, the writ petition. 4. On the other hand, learned Standing Counsel for Gram Panchayat appearing furnished written instructions dated 17.09.2025 issued by respondent No.4, wherein, the relevant portion of the said instructions is extracted hereunder: “ It is submitted that, the said assessment in which the petitioner has requested to provide private Tap connection was not in the name of the petitioner i.e., Sri Sabineni Murali Krishna, S/o.Gopala Rao and the owner of the said assessment is Smt.Sabineni Siva Samrajyam, W/o. Gopala Rao. Hence, the Gram Panchayat could not act on the representation submitted by the Sri Sabineni MuraliKrishna S/o.Gopala Rao i.e., petitioner in W.P.No.24130 of 2025.” 5. Learned Government Pleader for the respondents also submits that since the petitioner herein already submitted a representation dated 30.06.2025, the respondents would consider the same and appropriate orders, within a reasonable time. 6. Having regard to the submissions made by the learned counsel for the petitioner, learned Government Pleader and learned Standing Counsel for the respondents, this Court is of the considered view that the present writ petition 5 can be disposed of, directing the respondents to consider the representation dated 30.06.2025 submitted by the petitioner and pass appropriate orders, within a period of four (04) weeks from the date of receipt of a copy of this order. 7. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
