ORDER:
1. The petitioner is challenging the action of the respondents 1 and 2 in promoting the respondent as a teacher in 18*^ Ward of Vari Veedhi, Bobbili, Vizianagaram District, by ignoring the eligibility and seniority of the petitioner.
2. The petitioner and the 3'^'^ petitioner were working as Anganwadi helpers. The petitioner was working as Anganwadi helper at 18*^ ward, Rao Vari Center, Bobbili, Vizianagaram District, from
28.01.2008. One Smt Mahalakshmi who was working as a teacher of 18**^ ward Agraharam was resigned and the said post is lying vacant. The petitioner and the 3'"'^ respondent have submitted their applications for appointment as a teacher. \ However, the respondent authorities promoted the 3 respondent as teacher on 24.05.2012.
3. It is submitted by the learned counsel for the petitioner that the respondents have ignored the s^iority of the rd

4. The learned Assistant Government Pleader appearing for the respondents submits that the respondent considered eligible and G.O.Rt. No.102 dated 28.03.2002 was followed by the respondents 1 and 2. The petitioner was aged 27 years whereas the 3'^^ respondent aged 39 years. Considering the age of the 3"'^ respondent, she was preferred over the petitioner. It is also submitted that the 3"^ respondent has been discharging the duties teacher since then. was as
