The petitioner has filed this Writ Petition (C) under Article 226 of the Constitution of India assailing the order dated 30-3-2017 passed by respondent No.3 in Case No. 141/ID Act (Cr) and notice dated 31-3-2017 2 issued by respondent No.3 in Case No. 82 of 2017 by which the Judicial Magistrate First Class-cum-Labour Court, Rajnandgaon has initiated proceeding of contempt of court against the petitioner. 2. The Labour Court without considering the gravity of contempt of court has taken suo moto cognizance whereas the Labour Court is subordinate to the High Court and it is found that some indecent event has been taken place in the Court and he may refer to the High Court for initiating the contempt proceeding against the lawyer. 3. Since the proceeding initiated from the very beginning is without jurisdiction and non-est, therefore, the impugned order dated-30-3-2017 passed in Case No.141 ID Act (Cr) by the respondent No.3 and notice dated 31-3-2017 issued in Case No.82 of 2017 by the respondent No.3 initiating the contempt proceedings against the petitioner are quashed and proceedings are dropped. 4. Accordingly, the instant Writ Petition is allowed. 5. Pending interlocutory applications, if any, stand disposed of.
