1. Petitioner has filed this writ petition seeking following reliefs:-
“10.1. That, this Hon’ble Court may kindly be pleased to issue a writ of mandamus commanding to the respondent No.2, to take over the charge of the C.G. Athletics Association and proceed for election by appointing election officer accordance with the provisions of the Firms and Society Registration Act. 10.2. That, this Hon’ble Court may kindly be pleased to issue a writ of mandamus as to quash the notice Annexure P-11 issued by the respondent No.5, further commanding to the respondent no.5 to stop using letterpad of the C.G. Athletics Association inviting General Body Meeting, election process and deposit the amount of Rs.27 lakhs in the bank account of the C.G. Athletics Association. 10.3. That, any other relief which this Hon’ble Court deems fit and proper in favour of the petitioner may kindly be passed”

Learned counsel for petitioner submits that based on the application submitted, the Registrar, Firms and Societies, Raipur passed an order in exercise of powers under Section 32 of the Chhattisgarh Societies Registration Act, 1973 (for short ‘the Act of 1973’) directing to conduct election and to submit before it within 45 days in compliance of the provisions
3 of Section 27 of the Act. However, the order dated 7.5.2025 has not been complied with. He further submits that respondent No.5 has also issued notice holding the meeting with regard to affairs of the association. 3. Considering the facts pleaded in writ petition, submissions made by learned counsel for petitioner, in the considered opinion of this Court, if petitioner is aggrieved in any manner with any action taken by respondent No.5, he is having remedy available under the Act of 1973 of filing appropriate proceeding before appropriate authority. Therefore, I am not inclined to entertain this writ petition. 4. Consequently, writ petition is disposed of reserving liberty to the petitioner to available other remedy available to him under the law. Sd/- (Parth Prateem Sahu) Judge roshan/-
