Respondent(s) For Petitioner(s) : Shri Syed Ishadil Ali, Advocate For Respondent/State : Shri Ajit Singh, GA (Hon’ble Shri Justice Arvind Kumar Verma) Order on Board 29/10/2025 The applicant has filed this second bail application under Section 2 483 of the Bhartiya Nagrrik Suraksha Sanhita for grant of regular bail as he is in custody in connection with Crime No. 52/2024 registered at police station Badanji, District Bastar (CG) for the offence punishable under Sections 296,115(2), 103(1) an 3(5) of the BNS. The earlier bail application preferred by the applicant has been dismissed on merits by this Court. Counsel for the applicant submits that all the prosecution witnesses have been examined before the trial court and as such no fruitful purpose would be served by keeping the applicant in further custody. Per contra, learned State counsel opposes the bail application and submits that there is no material change in the circumstances after dismissal of the earlier application, and hence, the applicant is not entitled to bail. Heard counsel for the parties and considered the fact that the first bail application was dismissed on merits and there is no substantial change in the factual or legal circumstances of the case since. Then, merely because the witnesses have been examined, without any further ground of parity, delay or infirmity in the prosecution case, does not entitle the applicant to reconsideration of bail.
