1. This criminal miscellaneous bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.179/2025 registered at Police Station Sarund, District Kotputli-Behror for the offences punishable under Sections 318(4), 316(2), 316(3), 317(2), 306, 61(2) of the B.N.S.
2.
Learned counsel for the petitioner submits that the FIR in question has been lodged by the Manager of Munesh India Pvt. Ltd. referring specific names of drivers of the vehicle which are alleged to be involved in the offences mentioned in FIR. It is submitted that in the entire FIR, the petitioner had not been named, however, only on account of statements given by the owner of one vehicle in question the petitioner has been implicated in the present case. It is further submitted that no
[2025:RJ-JP:50552] (2 of 3) [CRLMB-14695/2025] recovery whatsoever of the chemical allegedly taken away through such vehicle, has been made from the petitioner. It is further submitted that after conducting the investigation from the petitioner, charge-sheet has been filed against him; he is behind the bars since 13.10.2025; offences alleged in the FIR are triable by the Magistrate. Consequently, he prays for granting him bail. 3. Learned Public Prosecutor has vehemently opposed this bail application and stated that for loading of the chemical in the truck, specific QR code is generated on the mobile of the driver and on 04.04.2025, such code was generated on the mobile of the petitioner. However, the Investigating Officer present in the Court has not disputed the fact that till this date either the chemical or sale proceeds thereof have been recovered from the petitioner or from anybody else. 4. Considered the submissions made at Bar. 5. In the light of above, after completion of investigation, charge-sheet has been filed, however, no recovery has been made from the petitioner and he is behind the bars since 13.10.2025, looking to the fact that his custody is not required to be continued for any further interrogation, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail. 6. Accordingly, this Bail Application is hereby allowed. The accused-petitioner Waris Khan S/o Sharif Khan shall be released on bail in pursuance of FIR No. 179/2025 registered at Police Station Sarund, District Kotputli-Behror on furnishing a
