ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to may be pleased to issue a Writ of Mandamus declaring (i) inaction of the Respondent No.2 to 6 in registering Crime and carrying out investigation thereto on Petitioners representations dated
08.10.2025 and 08.03.2023 as illegal, arbitrary, unreasonable, capricious and violative of Articles 14 and 21 of the Constitution of India and contrary to the provisions of the Criminal Procedure Code and the Bharatiya Nagarik Suraksha Sanhija, 2023 and (ii) consequently to direct the Respondents 2 to 6 to register Crime and carry out investigation in the same expeditiously (iii) and pass such….”
2. Heard Sri Akula Sri Krishna Sai Bhargav, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home.

Learned counsel for the petitioner would submit that Respondent No.7 filed O.S. No.51 of 2022 on the file of the Senior Civil Judge, Srikalahasti, for recovery of money and obtained an ex-parte decree on 13.08.2004. Aggrieved by the same, the petitioner preferred C.M.A. No.686 of 2005 before this Court, which was allowed, setting aside the ex parte decree. It is further submitted that Respondent No.7, who is an advocate, filed a vakalat by forging the signature of the petitioner and got the case closed by playing fraud on the Court, for which the petitioner submitted a representation to the police seeking

registration of a case. Learned counsel therefore prays that liberty may be granted to the petitioner to work out his remedy before the trial Court where the alleged fraud took place.

Learned Assistant Government Pleader for Home, on instructions, submits that though the petitioner filed a representation dated 08.10.2025 before Respondent No.3, after due enquiry it was found that the dispute between the petitioner and Respondent No.7 is purely civil in nature and is already pending before the Sub-Court, Srikalahasti. It is further submitted that the petitioner has not filed any written complaint against Respondent No.7 before the Srikalahasti I Town Police Station in respect of the alleged issue, and that the police are not interfering in civil disputes.
5. Considering the submissions, this Writ Petition is disposed of. However, the petitioner is at liberty to work out his remedy before the trial Court where the alleged fraud had taken place. There shall be no order as to costs.
