The instant petition under Article 227 of the Constitution of India has been filed on behalf of the petitioner challenging the order dated 6.12.2014 passed in Small Cause Suit No.5 of 2012 as well as for quashing the proceeding of execution case no.5 of 2015. 5. The order impugned was passed in the year 2014 and petition was filed in the year 2016. Stay vacation along with the counter affidavit was filed on behalf of landlord/ respondent in the year 2016 but no rejoinder affidavit has been filed till date. 6. On 10.9.2024 following order was passed by this Court: "Sri Sarvesh Kumar Singh, Advocate bearing Advocate Roll No. 0504/12 holding brief for Sri Ishwar Kumar Upadhyay, learned counsel for the petitioner informs the Court that petitioner had died, therefore, the case may be adjourned to enable him to file substitution application. List on 24.09.2024. " 7. No substitution application has been filed in respect to the sole-deceased petitioner. 8. The writ petition is dismissed for non-prosecution. 9. Interim order is vacated.
