Application has been filed by the applicant, challenging the order dated 04.01.2015 passed by learned Judicial Magistrate, Rishikesh, District Dehradun in Misc. Criminal Case No. 15 of 2015, Jagannath Kuksal Vs. Vinod and Others. Applicant has also challenged the order dated 02.09.2016 passed by learned 1st Additional District and Sessions Judge, Rishikesh, District Dehradun in Criminal Revision No. 20 of 2016, Jagannath Kuksal Vs. Vinod Negi and Others. 6. Earlier applicant filed an application under Section 156(3) Cr.P.C. against respondent no. 2. Learned Judicial Magistrate, Rishikesh rejected the said application vide order dated 04.01.2015. Against the said order, applicant filed Criminal Revision. The said criminal revision has also been dismissed by learned 1st Additional District and Sessions Judge, Rishikesh, District Dehradun vide order dated 02.09.2016. Hence, this criminal misc. application. 7. Perusal of the impugned orders passed by learned Magistrate reveals that he has considered & discussed all relevant aspects. Thus, the view taken by the learned Magistrate, cannot be faulted. Learned Revisional Court was thus justified in dismissing the Revision Petition.
