N SUBBA RAO 3 The Court made the following ORDER: This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: “….to issue an appropriate writ, order or direction, more particularly, one in the nature of Writ of Mandamus declaring the action of the 2nd Respondent in trying to pass the orders after the retirement of the 4th respondent to continue as Chief Engineer on contract basis of the 3rd respondent sugar factory even after his retirement, as arbitrary, illegal and contrary to law and consequently direct the 2nd respondent to appoint a suitable candidate for the said post of Chief Engineer for 3rd respondent Sugar Factory on permanent basis either by appointing or promoting suitable candidate immediately in the place of 4th Respondent forthwith in the interests of justice…..” 2.
