And 3 Others Counsel for Petitioner :- Alok Krishan Tripathi Counsel for Respondent :- G.A. Hon'ble Ms. Nand Prabha Shukla,J. Heard learned counsel for the petitioners, learned A.G.A. for the State and perused the record. The present Habeas Corpus Writ Petition has been filed with a prayer to issue a writ, order or direction in the nature of Habeas Corpus directing and commanding the respondent no.2 to 4 to produce the corpus, namely Baby Tanya Sahani (corpus) D/o Anil Kumar Sahani, (Petitioner No.1) and Baby Avantika Sahani (Corpus) D/o Anil Kumar Sahani (Petitioner No.2) before this Court as they are in illegal detention of respondent no. 4 and it is further prayed that they may be handed over to their father namely Anil Kumar Sahani (petitioner no. 3) to set them at liberty. It has been submitted by learned counsel for the petitioner no.3 Anil Kumar Sahani that the petitioner no.1 Baby Tanya Sahani (10 years) and petitioner no.2 Baby Avantika (8 years) (corpuses) are his minor daughters and both have been illegally detained by respondent no. 4 Smt. Minakshi Sahani (mother of the corpus).
Learned counsel for the petitioners has confined his prayer seeking relief of visitation rights to meet his minor daughters. From the records, it transpires that both the minor corpuses have not been illegally detained by the respondent no. 4. However, considering the paramount welfare of two minor daughters (corpuses), the petitioner no. 3 Anil Kumar Sahani, the father of the corpuses, is granted the visitation rights to meet both his minor daughters, i.e., the petitioner nos. 1 and 2 (corpuses) regularly on second and fourth Sunday of every month from 9:00 AM to 12:00 PM at the venue fixed by the S.H.O., District Sonbhadra which shall be other than the police station and shall make necessary efforts for compliance of the aforesaid order maintaining safety and security of the parties. With the aforesaid directions, the present Habeas Corpus Writ Petition is disposed of.
