Neutral Citation No. - 2025:AHC:137202-DB Court No. - 3 Case :- WRIT - C No. - 11436 of 2008 Petitioner :- Chandra Bhan Respondent :- D.V.V.N.L. And Others Counsel for Petitioner :- B.C. Rai Counsel for Respondent :- H.P. Dube Hon'ble Shekhar B. Saraf,J. Hon'ble Praveen Kumar Giri,J. Heard Sri B.C. Rai, learned counsel appearing on behalf of the petitioner. None appeared on behalf of the respondent, Electricity Distribution Company. In our view, this matter should go before the authority under section 127 of the Electricity Act, 2003. However, keeping in view the fact that the matter is pending since 2008 and the fact that the challenge in the present writ petition is with regard to wrong application of the formula under section 126 of the Electricity Act, 2003, we direct the petitioner to deposit a sum of Rs. 5 lakhs before the authority concerned and file an appeal within a period of four weeks from date. In the event, such deposit is made and appeal is filed within four weeks from date, the authority concerned should waive the balance amount and hear out the appeal after granting an opportunity of hearing to the petitioner. A reasoned order should be passed within a period of eight weeks from the date of receipt of the appeal filed by the petitioner. With the above direction, the writ petition is disposed of.
