Order 24/11/2025
1. By way of filing this criminal misc. petition, a prayer has been made for issuing a direction to the Investigating Officer to conduct fair, proper and impartial investigation in the impugned FIR No. 676/2024 registered with Police Station Sewar, District
(2 of 3) [CRLMP-1761/2025] Bharatpur for the offences under Sections 103(1) and 3(5) of BNS,
2023. 2. Counsel for the petitioner submits that under the unnatural circumstances, the deceased has passed away and the cause of death is firearm injury as per the post-mortem report. Counsel submits that the impugned FIR was registered in this regard on 23.12.2024 and more than eleven months have been passed thereafter and till date the matter has not been investigated by the Investigating Officer in a fair and impartial manner, therefore, appropriate direction be issued to the concerned Investigating Officer to conduct fair and impartial investigation. 3. Per contra, learned Public Prosecutor opposes the prayer made by counsel for the petitioner and submits that in order to get more clarity on the matter, seized articles from the earth where the alleged incident has occurred, have been sent to Forensic Science Laboratory (FSL) for its analysis and till date, the report has not been received. Counsel submits that the suspected persons have already been interrogated and their involvement was not found. Counsel submits that now, the new Investigating officer is making all possible endeavours to conclude the investigation and would submit the report before the Competent Court of law, hence interference of this Court is not warranted. 4. Heard and considered the submissions made at Bar and perused the material available on record. 5. This Court has perused the case diary and the report of investigation conducted so far and in order to analyse the objects/articles, which were seized from the place of occurrence, have been sent to the FSL. It appears that the FSL report has not
(3 of 3) [CRLMP-1761/2025] been received so far but the Investigating Officer cannot be allowed to sit idle if the report has not been received from the FSL. Thus, it is expected from the Investigating Officer to send the D.O. letter in that regard to the Superintendent of Police, Bharatput to get the FSL report and submit the conclusion report. 6. Considering overall facts and circumstances of the case, this Court deems it just and proper to dispose of the present criminal misc.
petition by issuing directions to the Investigating Officer to conduct a fair, impartial and unbiased investigation. He is also
directed to write a D.O. letter to the Superintendent of Police to get the report of FSL expeditiously. The Superintendent of Police, Bharatpur is also directed to personally monitor over the matter and instruct the concerned Investigating Officer to speed up the investigation of the case and submit the conclusion of investigation before the Competent Court of Law expeditiously, as early as possible.
7. With the aforesaid observations, the present criminal misc. petition stands disposed of.
8. Stay application and all pending application(s), if any, also stand disposed of.
