The learned counsel for the petitioner submits that the petitioner is seeking a direction to declare the action of the respondents 3 and 4 in freezing the savings account of the petitioner maintained at Station Bank of India, Vijayawada Branch. 2. The respondents 3 and 4 have issued instructions to the 7th respondent for freezing the bank account of the petitioner. The petitioner’s account was referred to in an interbank account related to fraud and as such investigation was initiated by the respondents 3 and 4. In that regard, the bank account of the petitioner was sought to be frozen. 3. The learned counsel for the petitioner submits that the petitioner is no way connected with the alleged offence and the petitioner was an employee working in senior position. The learned counsel for the petitioner places reliance on Neelkanth Pharma Logistics Pvt.Ltd Vs. Union of India and another1. The learned counsel for the petitioner submits that the cyber frauds and matters connected therewith fall under the jurisdiction of the state and they have to be dealt by the respective state. This observation was made on that submission of the learned counsel representing Union of India in the matter dealt by the High Court of Delhi. The Union of India was made a party respondent to 1 2025 SCC OnLine Del 1055 3 the writ petition where cyber fraud was considered. In that regard, the learned standing counsel appearing for the Union of India submitted that the cyber frauds which are under investigation would have to be considered by the respective State Government. 4. This Court had considered the similar issue in the matter of WP.No.10863 of 2025. This Court had declined to interfere with the investigation done by the respondents 3 and 4 and the other aspects such as freezing the bank account of the petitioner. 5. Considering the submissions, the present writ petition is dismissed, leaving it open for the petitioner to approach the appropriate forum. There shall be no order as to costs.
