Learned counsel appearing on behalf of the petitioner has very emphatically argued that despite the full knowledge of the pendency of the present writ petition, wherein the legality of the
order dated 25.3.2025 is under challenge, the respondent No. 3 ought to have waited for the outcome of the said writ petition. Taking into consideration the changed circumstances, as mentioned herein above, this Court at this stage finds that no useful purpose would be served to keep the present writ petition pending. Accordingly, the present writ petition is disposed of with liberty to the petitioner to challenge the said order dated 14.5.2025 passed in Case No. 2690 of 2024 under Section 116 of the U.P. Revenue Code, 2006 before the competent Court under Section 207 of the U.P. Revenue Code, 2006. It is provided that in case if the petitioner prefers appeal under Section 207 of the U.P. Revenue Code, 2006 before the competent Court having jurisdiction within a period of statutory limitation along with an application for interim relief, the same shall be considered by the appellate court strictly in accordance with law and shall make an endeavor to decide the same within a period of six months, as contemplated under Section 183 (4) of the U.P. Revenue Code Rules 2016. It is made clear that this Court has not entered into the merits of the case and has disposed of the writ petition enabling the petitioner to file statutory appeal before the competent Court. In the interest of justice it is provided that in case if the application for interim relief along with the aforesaid appeal under Section 207 of the U.P. Revenue Code, 2006 is filed within a period of 15 days from today, the said application shall be disposed of within a maximum period of one month from the date of its filing. The writ petition is accordingly disposed of. As an interim protection, it is provided that the parties shall maintain status quo in respect of the nature and possession of the
property for a period of two months from today or till the disposal of the application for interim relief whichever is earlier.
