Learned counsel for the applicants would submit that on 08.10.2025, counsel appearing for the petitioner was engaged in another Court, therefore, he could not appear when the case was taken up for hearing, therefore, the same was dismissed for want of prosecution. Hence, the said mistake was bonafide and the petitioner wants to contest the case on merits, thus the instant Cr.M.P. may be allowed. 3. On due consideration and for the reasons mentioned in the restoration application, instant Cr.M.P is hereby allowed. 4. Accordingly, the Registry is directed to restore Acquittal Appeal No.392/2019 (Ashok Kumar Sharma vs. Uttam Kumar Deshmukh) in its original number and list this case immediately after restoration.
