THE EXECUTIVE ENGINEER, WATER RESOURCES DEPARTMENT, SPECIAL DIVISION, VIJAYAWADA, KRISHNA DISTRICT. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of 2 VS,J W.P.No.20019 of 2021 WRIT OF MANDAMUS declaring the action of the respondents in non- payment of amounts due for the last three years even after finalizing the bills, payable to the petitioner after the successful completion of the execution of 2 works i.e., Construction of Check Dam 1 and 2 on Sandepu Vagu in Chekkapally Village in Musunuru Mandal of Krishna District under Neeru- Chettu programme duly approved by the respondents, as illegal, arbitrary, unjust, unreasonable and unconstitutional and consequently direct the respondents to consider the payment of amounts due to the petitioner in respect of execution of said works forthwith and to pass IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to pay the amounts payable to the petitioner for 2 works i.e., "Construction of Checkdam 1 & 2 on Sandepu Vagu in Chekkapally Village in Musunuru Mandal of Krishna District" executed by him under "Neeru-Chettu" programme immediately, pending disposal of the main writ petition and pass IA NO: 1 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to extend the time limit for implementation of the interim orders dated 03-11-2021 in I.A.No.1/2021 in W.P.No.20019/ 2021 for payment of amount for further period of four months from now onwards and pass such other order or Counsel for the Petitioner: 1. GP FOR IRRIGATION COMM AREA DEV The Court made the following: 3 VS,J W.P.No.20019 of 2021 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in non-payment of amounts due for the last three years even after finalizing the bills, payable to the petitioner after the successful completion of the execution of 2 works i.e., Construction of Check Dam 1 and 2 on Sandepu Vagu in Chekkapally Village in Musunuru Mandal of Krishna District under Neeru-Chettu programme duly approved by the respondents, as illegal, arbitrary, unjust, unreasonable and unconstitutional and consequently direct the respondents to consider the payment of amounts due to the petitioner in respect of execution of said works forthwith ….” 2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies. 3. When the matter came up for admission on 03.11.2021, this Court passed the following interim order: “….there shall be a direction to the effect that the 5th respondent shall pay Rs.15,35,998/- to the petitioner for the subject works within a period of four (4) weeks from this day. In default, the respondents shall pay interest at 9% p.a. on the above amount, till entire amount is realized by the petitioner.” 4. Today, when the matter came up for hearing, learned Assistant Government Pleader for Irrigation has furnished a copy of instructions of the Executive Engineer, Special Division, Vijayawada dated 20.09.2025, wherein it 4 VS,J W.P.No.20019 of 2021 is stated that the respondents have already paid the work bills to the petitioner on 20.04.2022 and 30.03.2025, as detailed below: Sl.
