The instant petition has been filed by the petitioner feeling aggrieved by order dated 21.10.2021, whereby special audit was to be conducted against the petitioner and for that purpose one notice dated 25.10.2021 was also issued against the petitioner. During pendency of the writ petition, one additional affidavit was filed by the petitioner indicating that after passing of impugned order dated 21.10.2021, one another order dated 13.02.2024 has been filed by the Regional Audit Officer Co- operative Societies, Jaipur Division, Jaipur, which reveals that in supersession/accumulation of earlier order dated 21.10.2021, now the department has decided to conduct the enquiry, if needed, under Section 55 of Rajasthan Co-operative Societies Act, 2001. 3. Learned counsel for the petitioner submits that in view of the fact that earlier order of special audit has been superseded and the petitioner is ready and willing to co-operate with the department in enquiry under Section 55 of the Act of 2001, he has got instructions to not press the present writ petition. 4. Learned counsel for the respondents has got no objection, in case, the petitioner is allowed to withdraw in the light of subsequent developments more particularly issuance of order dated 13.02.2024. 5.
