ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a Writ order, writ or direction, more particularly one in the nature of Writ of Mandamus declaring the inaction of the Respondents to forthwith defreeze the petitioner’s savings bank account bearing No.39024328107, maintained with SBI Kaigola Branch, Rajarhat, Kolkata, as being illegal, contrary to law arbitrary and violative of principles of natural justice and violative of Articles 14, 20 and 21 of the Constitution of India and consequentially direct the 2nd Respondent to produce the status of investigation in FIR Nos.25/2020 and 28/2020 and furnish reasons for continued procedural delay and to pass....…”
2. Heard Ms A.Padma Vanditha, learned Counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents.
3. Learned Assistant Government Pleader for Home has placed on record the written instructions furnished by the Inspector of Police, Cyber Crime Police Station, Visakhapatnam City. The relevant portion is usefully extracted hereunder:
“During the investigation, it was observed that the petitioner, Mr. Saddam Hosen, son of All Hossain, aged approximately 33 years, residing at Majherait, Rajarhat, Rekjuani, North Twenty Four Parganas, West Bengal-700135, received an amount of Rs.53,900 from the complainant’s account via PhonePe. It has been noted that the petitioner is managing several mule accounts, which immediately layered the funds into the petitioner’s account. It is essential to verify the connection between the petitioner and the mule account holder (accused), as indicated by the transactions.”

Learned counsel for the petitioner would submit that a direction may be given to the police to conclude the investigation and file a report.
5. Considering the submissions, this writ petition is disposed of. However, the police are directed to conclude the investigation and file a report according to law as expeditiously as possible preferably within a period of two months from the date of receipt of copy of this order. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________
