P.V.KUNHIKRISHNAN, J –------------------------------------- B.A. No. 3895 of 2025 -------------------------------------- Dated this the 28th day of March, 2025 O R D E R The petitioner earlier filed a bail application before this Court as BA No. 10599/2023. This Court dismissed that bail application on 25.02.2025 with following observations :
5.
“When this case came up for consideration, this Court was not inclined to grant bail to the petitioner. But, it is submitted that the evidence is already started. Hence, this Court directed the Registry to get a report from the Trial Court. The Additional Sessions Judge-III, Thrissur, submitted a report. It will be better to extract the same:-
“Referring to the above I may submit that taking into account of the pendency and number of time bound cases pending before this court, I believe that the case can be
disposed on or before 31.05.2025. Thus the report is being submitted before the Hon'ble High Court of Kerala for kind consideration and further direction in this regard.” From the above, it is clear that the learned Judge assured
BAIL APPL. NO. 3895 OF 2025 3 2025:KER:27176 that the case can be disposed of on or before 31.05.2025. If that is the case, no further orders are necessary. With the above observation, the bail application is disposed of directing the Jurisdictional Court to dispose S.C No.1252/2021 as expeditiously as possible, at any rate, on or before 31.05.2025.”
2. Now, the Public Prosecutor submitted that the trial is over and the case is posted for hearing. In such circumstances, I am not inclined to grant bail to the petitioner. The counsel for the petitioner submitted that he may be given interim bail. The petitioner is free to file appropriate application before the jurisdictional court in that regard and if such an application is filed, the jurisdictional court will consider the same, in accordance with law. With the above observation, this bail application is
disposed of.
