This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue Writ or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd Respondent in interfering with the civil dispute between the Petitioner and the Respondents 4 to 12, which is the subject matter of OS 151/ 2019 on the file of the Principal Junior Civil Judge, Pithapuram and CMA 1/2021 on the file of the XII Additional District and Sessions Judge, Pithapuram as illegal, arbitrary and violative of Article 14, and 21 of the Constitution of India, consequently direct the 2nd Respondent not to interfere with the civil dispute between the Petitioner and the Respondents 4 to 12 in the interest of justice” 2. Heard Sri G.Rama Gopal, learned counsel for petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for respondents. 3. Learned counsel for petitioner would submit police are interfering in the civil dispute and threatening the petitioner to withdraw O.S.No.151 of 2019 on the file of learned Principal Junior Civil Judge, Pithapuram and C.M.A.No.1 of 2021 on the file of learned XII Additional District and Sessions Judge, Pithapuram. 4. Learned Assistant Government Pleader for Home for respondents, on instructions, would submit that police are not interfering in the civil dispute between the parties. 5. Recording the same, the writ petition is disposed of. However, police are directed not to interfere in the civil dispute, except under due process of law.
