For the reasons stated in the accompanying affidavit and considering the
submissions made by the learned counsel for the petitioner, the petition is allowed condoning the delay of 198 days in filing petition to restore C.C.No.6827 of 2023.

This petition is filed to restore the Contempt Case contending that when the Contempt Case came before this Court for admission, learned counsel for the petitioner represented that the authorities have complied with the order dated 19.09.2023 passed by this Court in W.P.No.23529 of 2023 and prayed to close the said contempt case and accordingly, the same was closed by orders dated
17.07.2025. It is further stated in the petition that thereafter the petitioner verified the amount paid to him by the authorities and found that the
amount paid to him by the authorities is in relation to other claim, but the amount in respect of the present Contempt Case has not been paid by the authorities and the same is still outstanding, but due to oversight and miscommunication, learned counsel for the petitioner represented as if the amount covered under the contempt case has been paid. Therefore, prayed to restore the contempt case.
Heard Sri Durga Rao Ponnada, learned counsel for the petitioner.
Perused the contents of the petition and considered the submissions made by learned counsel for the petitioner.
The material shows that the petitioner filed W.P.No.23529 of 2023 claiming an amount of Rs.7,88,560/- being cost of the material supplied by him for the work of “construction of additional class rooms to ZPH School at APSP Quarters, H/o. Chintavalasa village in Denkada Mandal of Vizianagaram District. The said writ petition was disposed of on 19.09.2023 at the admission stage directing the authorities to release the admitted/legally entitled amount to the petitioner within a period of six (06) weeks.
Alleging non-compliance of the said orders, the petitioner filed C.C.No.6827 of 2023. When the same came up for consideration on 17.07.2025, on the representation made by the
learned counsel for the petitioner that the
authorities have complied with the order passed by this Court on 19.09.2023, the Contempt Case was closed.
The ground sought for restoration of the said C.C. is that the amount paid to the petitioner by the authorities is in relation to another work and therefore, the orders dated 19.09.2023 passed by this Court in W.P.No.23529 of 2023, disobedience of which is complained of in C.C.No.6827 of 2023, has not been complied with and hence to restore the Contempt Case to file.
It is evident that except stating that the amount paid to the petitioner by the authorities is in relation to the work other than the one covered under the orders of this Court in W.P.No.23529 of 2023 and the present contempt case, no material whatsoever was filed before this Court as to what was the other work executed by the petitioner besides the work covered under W.P.No.23529 of 2023. In the absence of any such material, the relief sought by the petitioner for restoring the Contempt Case cannot be granted.
Accordingly, the petition is dismissed. There shall be no order as to costs.
