(Oral) The applicant is in judicial custody in FIR No.13 of 2025, dated 06.01.2025, under Sections 8/21/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Patelnagar, Dehradun, District Dehradun. She has sought her release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 06.01.2025, 81.33 Grams Smack was allegedly recovered from the possession of the co-accused, who revealed that it is the applicant, who gives her Smack. 4. Learned counsel for the applicant would submit that the co-accused from whose possession 2 Smack has been recovered has already been granted bail; the applicant has been involved in the case merely based on the statement of the co-accused; there is no other evidence against the applicant. 5. Learned State counsel admits these facts. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on her executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
