GP FOR REVENUE (AP) 3 HBKM,J W.P.No.7301 of 2020 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondent Nos.1 to 4. 2. This writ petition was filed questioning the action of the respondent Nos.2 to 5 in trying to issue house site pattas to the third parties under the <Navaratnalu Pedalandariki Illu= Scheme in Sy.No.34 to an extent of Ac.0.25 cents of Chintalapeta Village, Gurla Mandal, Vizianagaram District, which is classified as <Gramakantam=. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that the respondents identified the Gramakantam land situated in Sy.No.34 measuring an extent of Ac.0.25 cents of Chintalapeta Village and prepared layout plan for providing house sites to the homeless poor of 15 beneficiaries under the welfare scheme of housing. The land in Sy.No.34 measuring an extent of Ac.0.25 cents is classified as Sarkar Poramboke in FCO (Fair Change Operation) and Poramboke in SFA of Ac.17.65 cents out of it Ac.0.25 cents was used as house sites which is shown in the layout plan and the rest of the land is vested with the Gram Panchayat and reserved for communal purposes which is shown in FMB. The petitioners are interested in the development activities in the Chintalapeta in Sy.No.34 to an extent of Ac.17.65 cents in Chintalapeta Village which is prepared for providing house sites under the Welfare Scheme and which is reserved for communal purpose in future besides the proposal 4 HBKM,J W.P.No.7301 of 2020 layout as per the G.O.Ms.No.558, Panchayat Raj & Rural Development (Pts- II) Department dated 02.03.2020. Ultimately, the 4th respondent stated that the vacant Gramakantam land, which was developed for the house sites by providing internal roads between the plots to the 15 beneficiaries, is at the stage of proposal. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 5 are directed to deal with the subject land strictly in accordance with law, if so warranted for any public purpose and if not already used for the above said public purpose under the welfare scheme of housing. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
