The Present application under Section 528 of BNSS has been filed by the applicant to quash the entire proceedings of Criminal Case No. 14479 of 2024 (State v. Prakash @ Omprakash and Others), arising out of Case Crime No. 133 of 2024, under Sections 147, 323, 324, 506, 307, 325 and 120B of IPC, P.S. Pilakhuwa, District Hapur, as well as cognizance/summoning order dated 25.9.2024, pending in the court of Chief Judicial Magistrate, Hapur. Learned counsel for the applicant submits that applicants do not want press the quashing of entire proceedings as well as summoning order passed by the trial court. It is further submitted that the applicant has been released on bail prior to submission of charge sheet under Sections 147, 323, 324, 506, 325 and 120B of IPC, P.S. Pilakhuwa, District Hapur. It is further submitted that one person sustained injuries in the incident. It is further submitted that applicant may be released under Section 307 of IPC on the basis of personal bond and sureties, which have been submitted earlier in the present case. In view of facts and circumstance of the case, the present application is disposed of with a direction to the trial court concerned to release the applicants on the basis of personal bond and two sureties, which have been filed earlier in the present FIR.
