Heard Sri Narsingh Pandey, learned counsel for the applicant, Ms. Ifra Islam, learned State Law Officer for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 98 of 2024, under Sections 420, 467, 468, 471 I.P.C. and 14 of Foreigners Act, Police Station- Sonauli, District- Maharajganj, during the pendency of trial. 4. As per prosecution story, applicant was apprehended by the police at the Sonali border when he was trying to enter Nepal without completing the immigration process. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence. The applicant is languishing in jail since 10.05.2024 and he is ready to cooperate with trial. In case, the applicant is released on bail, he will not misuse the liberty of bail. 6. Learned State Law Officer has vehemently opposed the bail application and argued that it is an open and shut case as the applicant used a fake visa which did not belong to him and which had already expired, as such he is not entitled for bail. 7. After hearing learned counsel for the parties and considering the rival submissions advanced, I do not find it a fit case for grant of bail to the applicant. 8. The bail application is found devoid of merits and is, accordingly, rejected.
