The Court made the following Order:
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning action of the respondents in trying to allot the private patta land of the petitioners to an extent of Ac.4-14 cents in Sy.No.216 situated at Mallepalle Village, Veldurthy Mandal, Kurnool District under ‘Navaratnalu-Pedalandariki Illu’ scheme to the 3rd parties without following due process of law. 3. On the other hand, the learned Assistant Government Pleader for the respondents relying upon the counter of the 4th respondent submits that the names of the petitioners have not been entered against the Sy.No.216 as alleged by them in the writ affidavit. They are never in enjoyment of the schedule land. Based on the notice issued by the petitioners they were given an opportunity to claim their right before the Tahsildar on 04.07.2020. They requested time for filing documents. The respondents never tried to evict high handedly without following the procedure as the petitioners are not enjoyers of the schedule land and hence the question of eviction and dispossession of the petitioners does not arise. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject land to an extent of Ac.4-14 cents in Sy.No.216 situated at Mallepalle Village,

Veldurthy Mandal, Kurnool District strictly in accordance with law. If the petitioners have got any grievance with respect to the subject land, it is open for them to approach the 4th respondent giving necessary representation enclosing all the necessary documents in support of their claim and on receipt of the same, the 4th respondent shall consider and dispose of the said representation of the petitioners if any, strictly in accordance with law. 5. Accordingly, the writ petition is disposed of. Interim order if any, deemed to have been vacated. There shall be no order as to costs.
