Although, two cases were earlier registered under Section 379 and 380 IPC against the petitioner in the year 2017- 18 however, both these cases have been closed by granting benefit of probation to the petitioner as the same were registered at the time when the petitioner was juvenile. 3. It is further submitted that petitioner is behind the bars since 20th September, 2025 and no further investigation is required to be made from the petitioner. Trial in the case is likely to be take considerably long time. Hence the prayer is made to grant the bail of petitioner in the instant matter. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. Considered the submissions made at Bar. 6.
In the light of the fact that the mode of recovery and arrest has been disputed by learned counsel for the petitioner while citing provisions of Section 42, 50 & 55 of the Act of 1985 and the recovery of contraband against the petitioner is less than commercial quantity and there are no past antecedents against the petitioner in respect of the N.D.P.S. Act, without making any comments over the merits of the case, I am inclined to grant bail to the petitioner. 7. Accordingly, the Bail Application is hereby allowed. The accused-petitioner Rajkumar Meena S/o Mansingh Meena shall be released on bail in pursuance of FIR No.313/2025 registered at Police Station Jamdoli District Jaipur City (East) on furnishing a personal bond of Rs.1,00,000/- along with two
