It is submitted that petitioners have filed application for membership to respondent no.4 on 27.08.2024 as per Annexure-A to E1, respectively, in previous order. Same has not been considered despite petitioners having complied with required formalities. Therefore, submits that in view of ratio laid down by this Court in Shirahatti Taluk Agricultural Produce Marketing Co-operative Niyamit v. The State of Karnataka and others reported in NC:2025:KHC-D:12294 and in Sriram Poultry Farming Farmers Co-operative Society Ltd., Uppinakere and others v. The Registrar, Co-operative Societies and others reported in NC:2025:KHC:51589, petitioners would be entitled for deemed membership, however their names were not included either in list of eligible voters or ineligible. Such being case, it was submitted that respondent no.4 was - 4 - HC-KAR NC: 2025:KHC-D:18732 WP No. 109947 of 2025 proceeding to conduct election for Managing Committee of respondent no.4 scheduled on 06.01.2026 without including the names of petitioners in voters’ list. Therefore, seeks for grant of interim order permitting them to participate. 3. Learned Additional Government Advocate appears for respondents no.1 to 3. 4. Sri.P.Anand takes notice for respondent no.4 and opposes writ petition. 5. Considering facts and circumstances and taking note of order passed by this Court in above referred cases, present writ petition is disposed of permitting petitioners to file representations with respondent no.4 within three days from today and directing respondent no.4 to consider same in light of directions issued in Shirahatti Taluk Agricultural Produce Marketing Co-operative Niyamit and in Sriram Poultry Farming Farmers Co-operative Society Ltd., within a period of one week thereof, taking note of fact that ensuing election is scheduled on 06.01.2026. - 5 - HC-KAR NC: 2025:KHC-D:18732 WP No. 109947 of 2025 6.
