Present applicant–Aquib@Nanhe, is seeking bail in relation to first information report dated 31.10.2024 bearing FIR No. 0461 of 2024, Police Station Kaliyar Sharif, District Haridwar, wherein the present applicant has been implicated for the offence punishable under Section 137(2), 87, 67(2)(m) of the BNS Act, 2023 and under Section 5(1)/6 of Protection of Children from Sexual Officen Act, 2012. 4. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated. He further submits that the victim herself does not support the case of the prosecution and, in fact, the present applicant was in love with the victim. Apart from this he submits that even the medical report does not support the case of the prosecution. 5. Per Contra, learned State Counsel Mr. Siddhartha Bisht, vehemently opposed this bail application by saying that the victim, at the time of incident, was minor and aged about 15 years and the medical report supports the case of the prosecution. 6. After hearing the arguments as advanced by learned counsel for the 2025:UHC:2549 parties, and after gone through the FIR including the medical report, this Court is of the view that the applicant is not entitled for bail. 7.
