Heard learned counsel for petitioner. 2. Learned counsel for petitioner submitted that earlier Amala Singh (respondent in present petition) has filed Matters Under Article 227 No. 4857 of 2023 in which, upon statement made by counsel for petitioner in that petition, petition was disposed of vide order dated 16.05.2023 with direction to the petitioner in that petition to vacate the house in question within 12 months. Later on, time extension application was filed in the same petition in which vide order dated 20.05.2024, one month and no more time was granted to Amala Singh to vacate the house in question. Now, after completion of time so given by this Court, petitioner in that petition has started pressing Execution Case No. 12 of 2020, which is pending before Execution Court. Instead of vacating the house in question, respondent-Amala Singh is moving frivolous application. He lastly submitted that a direction may be issued to the Execution Court for ensuring the execution of orders of this Court dated 16.05.2023 & 20.05.2024 passed in Matters Under Article 227 No. 4857 of 2023. 3. It is apparently clear that after completion of time as given by this Court in Matters Under Article 227 No. 4857 of 2023, respondent-Amala Singh is having no option but to vacate the house in question and any objection/application moved to retain the house in question should not be entertained by the Court. 4. Therefore, under such facts, writ petition is disposed of with direction to Special Judge (SC/ST Act), Varanasi to ensure the vacation of house in question, maximum within a period of two months from today without entertaining any objection/application to retain the house in question.
