No. 161 of 2021 for the punishable offence u/s 420 of IPC and 7 of E.C. Act, is illegal, improper and without any power of authority under law and violation of Article 19(1)(g) of the constitution of India and against the principals of natural justice and consequently to direct the respondents to release 1186 bags ie 296.40 quintals of rice, which was seized in connection with the case in C.C. No. 161 of 2021 and hand over to the 1st petitioner and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents to release 1186 bags ie 296.40 quintals of rice which was seized in connection with the case in C.C. No. 161 of 2021 for the punishable offence u/s 420 of IPC and 7 of E.C. GP FOR CIVIL SUPPLIES The Court made the following: 4 VS,J W.P.NO.9325 OF 2023 O R D E R: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- <…to issue a writ order or direction more particularly one in the nature of Writ of Mandamus, by declaring the action of the respondents in seizing 1186 bags ie 296.40 quintals of rice of the 1st petitioner in connection with the case in C.C. No. 161 of 2021 for the punishable offence u/s 420 of IPC and 7 of E.C. Act, is illegal, improper and without any power of authority under law and violation of Article 19(1)(g) of the constitution of India and against the principals of natural justice and consequently to direct the respondents to release 1186 bags ie 296.40 quintals of rice, which was seized in connection with the case in C.C. No. 161 of 2021 and hand over to the 1st petitioner.….= 2. Today, when the matter came up for hearing, the learned Assistant Government Pleader for Civil Supplies, furnished a copy of the written instructions received from the Collector (CS), Krishna Machilipatnam, Vide E.C.P.No.56/2021 dated 02.12.2025. wherein it is stated that as per the orders of the Joint Collector, Krishna District, Machilipatnam, issued in E.C.P. No.56 of 2021 dated 11.09.2023, the seized stock of 296.40 quintals of rice was released from the custody of Suvera Agro Industries, Kanumolu Village, Bapulapadu Mandal and handed over to the petitioner No.3, Sri Sai Rice Mill, Banganapalli Village, Kurnool District, on 30.11.2023, with a direction to sell the handed over 5 VS,J W.P.NO.9325 OF 2023 stock within 10 days from the date of such handover, which was also acknowledged by the petitioners. 3. Recording the same, no further cause survives in the writ petition. 4. Accordingly, the writ petition is closed. There shall be no order as to costs.
